Law 360: Ex-Radnor CEO Wants 3rd Circ. To Rethink Skaden Win

Robert Bernstein, An attorney for Kennedy, told Law 360, "This case is about due process, fairness and integrity in the bankruptcy process. I hope the judges on the Third Circuit will take a careful look at what appears to have happened here."

Bernstein also said that no law firm should be allowed to wait until after the statute of limitations has passed to disclosed that its partners help an ownership stake in a creditor, "particularly where," he added, "instead of working on a plan of reorganization, the debtor's counsel instead negotiated the sale of substantially all of the debtor's assets to that creditor.
